Welcome to PCDS, we are happy you chose to visit our site.
The Privacy, Compliance & Data Security Association (PCDS) forges a synergy among privacy, compliance, and data security professionals. PCDS provides a forum for privacy, compliance and data security professionals to come together to advance, inspire, innovate and collaborate across industry subject matter experts (SMEs).

The PCDS forum offers opportunities for professionals to share industry best practices and advance their knowledge in their respective fields with specialized education. PCDS is committed to offering its members professional development and networking as part of its goals to ensure all privacy, compliance and data security professionals are current on relevant issues. This includes regular conferences, discussions, national debates, webinars, newsletters, and other educational resources. PCDS will also organize events to discuss and debate developing issues having an immediate effect on privacy, compliance and security.
All Privacy, Compliance and Data Security professionals are permitted to register to become a member of the PCDS professional community.
At registration, you provide us with basic information about yourself or your company; we may seek to verify your information (we may work with third parties to do so). Your account shall be activated upon verification by us or our third party. You give us permission to do this and to periodically update the information or we will decline to offer our professional services to you.
Payment and Payment Methods
Refund and Return Policy
Other than technical errors or errors on the part of PCDS or its third party service provider, all payments are final and will not be refunded. In the case of technical errors or errors on the part of PCDS or its third party service provider all refund requests must be submitted in writing via email to email@example.com. PCDS will process all requests within a business acceptable time frame to investigate, review and report our findings back to the member who placed the request. Also see Liability for our Services section in this agreement.
Using our Services
Use our services only as permitted. We may suspend or stop providing our services to you if you do not comply with our terms or policies or if there is pending investigation for suspected misconduct.
Using PCDS’ services does not give you ownership of any intellectual property rights in PCDS’ services or the content you access. You may not use content from PCDS’ services unless you obtain permission. These terms do not grant you the right to use any branding or logos used in our services. Do not remove, add or change any legal notices displayed in or along with our services.
Services and contents that are not PCDS’ are the responsibility of the party that makes it available. PCDS may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law.
In connection with your use of Services, we may send you service announcements, administrative messages, and other information. However, you may opt out of some of these communications.
Your PCDS Account
You may need a PCDS Account in order to use some of our Services. You may create your own PCDS Account, or your PCDS Account may be assigned to you by an administrator. PCDS will from time to time log user level activities for incident management and investigations purposes. To protect your PCDS Account, we recommend that you keep your password confidential. You are responsible for the activity that happens on or through your PCDS Account. Try not to reuse your PCDS Account password. If you learn of any unauthorized use of your password or PCDS Account, report immediately to PCDS by calling 484.983.3134 or emailing us at firstname.lastname@example.org.
Privacy and Copyright Protection
PCDS will respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the U.S. Digital Millennium Copyright Act.
Your Content in our Services
PCDS will allow you to upload, submit, store, send or receive content. The intellectual property rights that you hold in that content belongs to you.
When you upload, submit, store, send or receive content to or through our Services, you give PCDS (and those we work with) license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), publicly, communicate, publish, perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services (for example, for a business listing you have added to PCDS publishable directories). Some Services may offer you ways to access and remove content that has been provided to that Service. Make sure you have the necessary rights to grant us this license for any content that you submit to our Services.
About Software in our Services
PCDS will update the software and update to newer versions and features as they become available from the vendor. You are required to update your personal computers as general best practices to ensure that infected programs and services are not propagated during upstream and downstream cyber activities.
Modifying and Terminating our Services
PCDS will continue to change and improve its Services. PCDS may add or remove functionalities or features as technology advances and we may suspend or stop a service altogether
As a member, you can stop using our Services at any time. PCDS may also stop providing Services to its members, or add or create new limits to our Services at any time as technology advances.
We believe that you own your data and preserving your access to such data is important. If PCDS discontinues a Service, where reasonably possible, PCDS will give its members reasonable advance notice and a chance to get information out of that Service.
Our Warranties and Disclaimers
PCDS provides our Services using a commercially reasonable level of skill and care and we hope that our members enjoy using them. We do not promise the following services.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER PCDS NOR ITS SERVICE PROVIDERS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. PCDS PROVIDE THE SERVICES “AS IS”.
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES. PCDS IS A MEMBER SUPPORTED NON-PROFIT AND DOES NOT HAVE THE FINANCIAL, RESOURCES, AND POLITICAL CAPITAL TO IMPLEMENT ALL RECOMMENDATIONS.
PCDS IS NOT A POLITICAL AFFILIATED GROUP AND DOES NOT ENDORSES OR DISCRIMINATE AGAINST ANY GROUPS OR INDIVIDUAL ON THE BASES OF THEIR RACE, GENDER, RELIGION OR COUNTRY OF ORIGIN.
Liability for our Services
WHEN PERMITTED BY LAW, PCDS, AND PCDS’S SERVICE PROVIDERS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT LOSSES, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PCDS, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).
IN ALL CASES, PCDS, AND ITS SERVICE PROVIDERS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE.
Business uses of our Services
For our members using PCDS Services on behalf of a business, the business accepts these terms. PCDS members hold harmless and indemnify PCDS and its service providers, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorney’s fees.
About these Terms
PCDS may adjust these terms or any additional terms that apply to a Service, for example, reflect changes to the law or changes to our Services. We encourage you to review our terms regularly. PCDS will post notice of modifications to these terms on this page. Changes will not apply retroactively and will become effective no sooner than 15 days after they are posted. Changes that addresses new functions for a Service or changes made for legal reasons will be implemented immediately. Our members can discontinue their use of our services if they disagree to the modified terms for a Service.
These terms control the relationship between PCDS and our members. The terms do not create any third party beneficiary rights.
For members who do not comply with these terms, if PCDS does not take action right away, it does not mean that we are giving up any rights that we may have (such as taking action in the future). All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of New Castle County Wilmington DE, USA, and our members and PCDS consent to personal jurisdiction in those courts.

Types of Information Collected on PCDS Website finallypcds.org
Two types of information are collected on the finallypcds.org website.
- Anonymous information is information that cannot be traced back to a specific individual. Anonymous information is sometimes referred to as “count.” We use this anonymous information to obtain a better understanding of how visitors use our website and to make decisions on how to improve it.
- Personally identifiable information (PII) is information you provide that lets PCDS know specific facts about you so that we can respond to your requests (e.g. Share Your Experience, Request an Appointment). Personal information collected on our site is used only to allow us to fulfill your request for services. PCDS will use your personal information only for the purpose for which it was submitted.
What Is Personal Information?
Your personal information is any information that can be associated with you, where you live or work, or anything that is associated with your identity. The following are examples of personal information:
Driver’s license number
Credit card number
Date of birth
Gender or race
When Do We Collect Your Personal Information?
There are several ways PCDS collects personal information from a visitor to our website:
- IP Address Capture
- Form Submission
IP Address Capture
An Internet Protocol (IP) address is a number automatically assigned to your computer whenever you access the Internet. IP addresses allow computers and servers to recognize and communicate with one another. The finallypcds.org web server may automatically collect the IP address of computers that accesses our site.
We may place small data files, called “cookies,” in your browser’s file storage area of your computer’s hard drive. A cookie is a small text file that is stored on a site visitor’s computer to gather and keep track of information related to you. These cookies automatically identify your browser to our server whenever you interact with a service provided on our website. There are two types of cookies commonly used on websites:
- Session cookie: A temporary file created when a website is accessed and terminates when the web browser is closed.
- Persistent cookie: A permanent file that must be deleted manually.
When you choose to engage with the finallypcds.org website by submitting a registration form, your information will be sent to PCDS via our TLS/SSL encrypted communication.
Sending Your Information by Email
Another way PCDS may receive your personal information is if you send an email. Sending email without encryption is not secure. PCDS does not accept responsibility for the protection of information transmitted in an email. We recommend that you DO NOT send anything private or confidential by email.
How Do We Use Your Information?
We may collect and log IP addresses in order to analyze site visitation trends and administer the website. IP address information allows us to properly administer our system and gather aggregate information on visitors to our website to help diagnose problems with our servers and how our site is being used, including the pages visitors are viewing in the aggregate. This aggregate information may be shared with third parties, such as our internal information technology department and in a limited capacity, our vendors who provide website development and design services.
To help us determine the effectiveness of the PCDS website, we may work with analytics tools hosted by third parties who receive information from your browser. The following are examples and explanations of information we receive from third parties:
- Domain name: Webpage from which the user accesses our website
- Referral data: Address of the last URL visited prior to clicking through to our website
- Browser and platform type: Chrome, Apple OS, etc.
- Activity and general traffic flow while on our site: pages visited
- General geographic location
- IP address
- Social media platform you visit after leaving our website: Facebook, Twitter, Instagram, etc.
- Device: phone, tablet, computer, etc.
This information does not include name, address, email, or link any identifying information to a specific IP address. Information is presented in aggregate form and is used for internal statistical analysis only.
Cookies help us review website traffic patterns and improve our site. Most browsers automatically accept these cookies, but you usually can change your browser setting to prevent the acceptance of cookies. Not accepting cookies may prevent you from using some of the functions or features of our website.
How We Use Submitted Information when you register with us.
Form information you provide can range from your name, email and phone number, to specific personal information. Forms submitted within our site run in a secure-server environment. When you enter sensitive information into a form on our website, your information is encrypted in transit using our TLS/SSL enabled communication protocol. We are committed to doing everything reasonably possible to protect the user information we collect. All of our users’ information, not just the sensitive information, is restricted to access in our offices. Only individuals who need the information to perform a specific job are granted access to personal information. Access to this information is password protected. Furthermore, all personnel having access to your personal information are kept up-to-date on our security and privacy practices.
Disclosures Required to Investigate Complaints or to Law Enforcement Officials
PCDS may disclose your personal information to another party, such as law enforcement officials, to comply with legal requirements, court orders, government or law enforcement agency requests, to protect or defend PCDS or where we perceive an immediate danger of death or serious physical injury to someone as a result of activity on our site. Our disclosures may occur under circumstances where we may not be authorized to advise you of such action.
Children’s Privacy Protection
The PCDS website is intended for use by visitors 18 years of age and older.
About Privacy on Other Websites
We are not responsible for any comments you make on social media channels such as Facebook or Twitter. If you choose to share personal information, you do so at your own risk. Please review the privacy policies on any social media channel before engaging interactively on any social media platform.
Website Tracking and Your Opt-out Right
Currently, PCDS is not able to respond to browser “do not track signals.” However, you have the option to do so at the browser level. The following links may assist you:
